August 30, 2010 Johnson & Johnson subsidiary DePuy Orthopaedics has issued a voluntary recall of two of its hip replacement systems due to a high rate of implant failure


After receiving hundreds of complaints about the product, Johnson & Johnson unit DePuy Orthopaedics finally recalled its ASR hip replacements. This hip replacement system has a shockingly high rate of failure, and many of the victims of these failures have had to undergo a second, painful surgery to remove and replace the defective hip.

For years, DePuy has been blaming the doctors who use their products for the ever-growing failure rate. Rather than admit that a defect exists, DePuy’s spokesperson instead has told newspapers that failures can be attributed to doctors not following directions. Even as recently as August 16th, DePuy is also blaming patients, claiming that they were “careless and at fault” and claiming that the victims of the ASR hip failure “conducted themselves so as to contribute substantially to their own injuries and damages.”

Dr. Stephen Graves, the Director of the National Joint Replacement Registry in Australia, said “It is a complete untruth that DePuy did not have reason to withdraw the ASR before now; we have been telling them since 2007, but they allowed it to be used on thousands of people.”

Brian Devine, an attorney who represents patients injured by the DePuy hip replacement said, “DePuy should have recalled this defective and dangerous hip implant years ago when it first learned of the defect. If it had, 90,000 people would not now face the possibility of a failed hip implant and a painful and risky surgery to replace it. We are pleased that DePuy has finally admitted that its hip implant is defective and is taking steps to prevent even more people from being injured by this product.”
